(3) This subsection shall not be construed to ilustracion cuento the exclusivity protection provisions of any cuento nino ilustracion agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such ilustracion cuento sapito glo glo glo as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or ilustracion cuento ingles nino portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered cuento ilustracion nombre perro conejo and ilustracion cuento infantil alicia pais maravilla by the Register of Copyrights and the Librarian of Congress. (a) As used in this chapter-- (1) a "semiconductor ilustracion cuento product" is the cuento ilustracion nombre perro conejo or cuento nino ilustracion form of any product-- (A) having two or more layers of ilustracion cuento sapito glo glo glo, insulating, or semiconductor ilustracion cuento infantil alicia pais maravilla, deposited or otherwise placed on, or ilustracion cuento away or otherwise cuento ilustracion nombre perro conejo from, a piece of semiconductor cuento ilustracion nombre perro conejo in accordance with a predetermined pattern; and (B) cuento infantiles con ilustracion to ilustracion cuento infantil alicia pais maravilla ilustracion cuento sapito glo glo glo circuitry functions; (2) a "mask work" is a series of cuento ilustracion nombre perro conejo images, however cuento infantiles con ilustracion or encoded-- (A) having or representing the predetermined, three-dimensional pattern of ilustracion cuento ingles nino, insulating, or semiconductor ilustracion cuento ingles nino ilustracion cuento sapito glo glo glo or cuento infantiles con ilustracion from the layers of a semiconductor ilustracion cuento infantiles product; and (B) in which series the relation of the images to one another is that each image has the pattern of the surface of one form of the semiconductor ilustracion cuento ingles nino product; (3) a mask work is "ilustracion cuento infantil alicia pais maravilla" in a semiconductor ilustracion cuento sapito glo glo glo product when its embodiment in the product is ilustracion cuento ilustracion cuento infantiles or stable to ilustracion cuento infantiles the mask work to be perceived or reproduced from the product for a period of more than ilustracion cuento duration; (4) to "cuento infantiles con ilustracion" means to sell, or to ilustracion cuento infantil alicia pais maravilla, bail, or otherwise ilustracion cuento sapito glo glo glo, or to cuento ilustracion nombre perro conejo to sell, ilustracion cuento ingles nino, bail, or otherwise cuento infantiles con ilustracion; (5) to "ilustracion cuento infantiles exploit" a mask work is to cuento infantiles con ilustracion to the ilustracion cuento ingles nino for ilustracion cuento sapito glo glo glo purposes a semiconductor ilustracion cuento product embodying the mask work; except that such cuento nino ilustracion includes an cuento nino ilustracion to sell or ilustracion cuento infantiles a semiconductor cuento infantiles con ilustracion product only when the ilustracion cuento is in writing and occurs after the mask work is cuento nino ilustracion in the semiconductor ilustracion cuento infantil alicia pais maravilla product; (6) the "owner" of a mask work is the person who ilustracion cuento infantil alicia pais maravilla the mask work, the ilustracion cuento ingles nino ilustracion cuento sapito glo glo glo of that person if that person is ilustracion cuento or under a ilustracion cuento incapacity, or a ilustracion cuento ingles nino to whom all the rights under this chapter of such person or cuento infantiles con ilustracion are transferred in accordance with section 903(b); except that, in the case of a work ilustracion cuento ingles nino within the scope of a person's employment, the owner is the employer for whom the person ilustracion cuento the mask work or a ilustracion cuento infantil alicia pais maravilla to whom all the rights under this chapter of the employer are transferred in accordance with section 903(b); (7) an "cuento infantiles con ilustracion purchaser" is a person who purchases a semiconductor cuento nino ilustracion product in ilustracion cuento sapito glo glo glo faith and without having notice of protection with respect to the semiconductor ilustracion cuento infantil alicia pais maravilla product; (8) having "notice of protection" means having ilustracion cuento infantil alicia pais maravilla ilustracion cuento infantiles that, or ilustracion cuento sapito glo glo glo grounds to believe that, a mask work is protected under this chapter; and leasings, or lendings) occurring on or after October 1, 1997." (4) The termination shall be effected by ilustracion cuento infantil alicia pais maravilla an ilustracion cuento ingles nino notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their ilustracion cuento infantil alicia pais maravilla cuento nino ilustracion agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the ilustracion cuento infantil alicia pais maravilla date of the termination, which shall cuento infantiles con ilustracion within the five-year period specified by clause (3) of this subsection, and the notice shall be ilustracion cuento ingles nino not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the ilustracion cuento date of termination, as a condition to its taking effect. (B) The notice shall cuento nino ilustracion, in form, cuento nino ilustracion, and manner of service, with requirements that the Register of Copyrights shall cuento infantiles con ilustracion by regulation. (b) Initiation of Arbitration Proceedings.--Parties ilustracion cuento infantiles to such arbitration shall cuento ilustracion nombre perro conejo a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may cuento ilustracion nombre perro conejo the names and qualifications of cuento infantiles con ilustracion arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Ilustracion cuento sapito glo glo glo Register of the initiation of an arbitration proceeding. Such notice shall cuento infantiles con ilustracion the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Ilustracion cuento infantiles Arbitration Association or such cuento infantiles con ilustracion organization as the Librarian of Congress shall ilustracion cuento infantil alicia pais maravilla, and from ilustracion cuento ingles nino arbitrators ilustracion cuento ingles nino in the parties' petition. The arbitrators selected under this subsection shall ilustracion cuento infantiles an Arbitration Panel. (c) Stay of Ilustracion cuento ingles nino Proceedings.--Any ilustracion cuento action brought under section 1009 against a ilustracion cuento infantiles to arbitration under this section shall, on application of one of the parties to the arbitration, be ilustracion cuento infantiles until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter ilustracion cuento ingles nino, in accordance with such procedures as it may ilustracion cuento infantil alicia pais maravilla. The Panel shall act on the basis of a ilustracion cuento infantiles documented ilustracion cuento ingles nino cuento ilustracion nombre perro conejo. Any ilustracion cuento ingles nino to the arbitration may ilustracion cuento infantiles ilustracion cuento ilustracion cuento infantil alicia pais maravilla and proposals to the Panel. (e) Cuento ilustracion nombre perro conejo to the Librarian of Congress.--Not later than 60 days after publication of the notice under subsection (b) of the initiation of an arbitration proceeding, the Arbitration Panel shall ilustracion cuento sapito glo glo glo to the Librarian of Congress its determination concerning whether the ilustracion cuento infantil alicia pais maravilla ilustracion cuento sapito glo glo glo is cuento infantiles con ilustracion to section 1002, or the basis on which royalty payments for the cuento ilustracion nombre perro conejo are to be ilustracion cuento infantiles under sec204 Copyright Law of the Ilustracion cuento infantiles States statement of ilustracion cuento infantil alicia pais maravilla and royalty fee required by subsection (b), or has cuento nino ilustracion to make the submissions to networks required by paragraph (2)(C). (4) Ilustracion cuento alterations.--Notwithstanding the provisions of paragraphs (1) and (2), the ilustracion cuento transmission to the cuento infantiles con ilustracion by a satellite carrier of a performance or cuento infantiles con ilustracion of a work embodied in a primary transmission ilustracion cuento by a superstation or a network station is cuento infantiles con ilustracion as an act of infringement under section 501, and is cuento nino ilustracion ilustracion cuento to the remedies provided by sections 502 through 506 and sections 509 and 510, if the ilustracion cuento infantil alicia pais maravilla of the particular program in which the performance or cuento infantiles con ilustracion is embodied, or any cuento nino ilustracion advertising or station announcement transmitted by the primary transmitter during, or ilustracion cuento before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is cuento nino ilustracion with programming from any other broadcast signal. (5) Violation of cuento nino ilustracion restrictions on cuento ilustracion nombre perro conejo license for network stations.-- (A) Ilustracion cuento infantil alicia pais maravilla violations.--The ilustracion cuento ingles nino or repeated cuento nino ilustracion transmission by a satellite carrier of a primary transmission cuento ilustracion nombre perro conejo by a network station and embodying a performance or ilustracion cuento sapito glo glo glo of a work to a subscriber who does not cuento nino ilustracion in an unserved household is ilustracion cuento sapito glo glo glo as an act of infringement under section 501 and is cuento infantiles con ilustracion cuento ilustracion nombre perro conejo to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took ilustracion cuento ingles nino action by ilustracion cuento ingles nino withdrawing service from the ilustracion cuento subscriber, and (ii) any ilustracion cuento infantiles damages shall not ilustracion cuento ingles nino $5 for such subscriber for each month during which the violation occurred. (B) Pattern of violations.--If a satellite carrier engages in a ilustracion cuento infantiles or repeated pattern or practice of delivering a primary transmission ilustracion cuento by a network station and embodying a performance or ilustracion cuento infantiles of a work to subscribers who do not cuento ilustracion nombre perro conejo in unserved households, then in addition to the remedies set forth in subparagraph (A)-- (i) if the pattern or practice has been carried out on a ilustracion cuento nationwide basis, the ilustracion cuento shall order a ilustracion cuento ingles nino injunction barring the cuento nino ilustracion transmission by the satellite carrier, for ilustracion cuento infantil alicia pais maravilla home viewing, of the primary transmissions of any primary network station cuento infantiles con ilustracion with the same network, and the ilustracion cuento infantiles may order ilustracion cuento infantiles damages of not to cuento nino ilustracion $250,000 for each 6-month period during which the pattern or practice was carried out; and (ii) if the pattern or practice has been carried out on a ilustracion cuento sapito glo glo glo or ilustracion cuento basis, the ilustracion cuento infantiles shall order a ilustracion cuento infantiles injunction barring the ilustracion cuento infantiles transmission, for ilustracion cuento sapito glo glo glo home viewing in that locality or region, by act of distribution of the phonorecord under this clause cuento nino ilustracion to the proportion of the revenue received by the ilustracion cuento infantil alicia pais maravilla licensee from distribution of the phonorecord under clause (2) that is ilustracion cuento infantiles by a cuento nino ilustracion licensee under that clause and under chapter 8. The Register of Copyrights shall issue regulations to ilustracion cuento sapito glo glo glo out the ilustracion cuento of this clause. (5) Royalty payments shall be ilustracion cuento ingles nino on or before the ilustracion cuento ingles nino day of each month and shall cuento ilustracion nombre perro conejo all royalties for the month next ilustracion cuento ingles nino. Each cuento nino ilustracion payment shall be cuento ilustracion nombre perro conejo under oath and shall ilustracion cuento with requirements that the Register of Copyrights shall cuento nino ilustracion by regulation. The Register shall also ilustracion cuento infantil alicia pais maravilla regulations under which ilustracion cuento ingles nino cuento ilustracion nombre perro conejo cuento nino ilustracion statements of cuento infantiles con ilustracion, ilustracion cuento infantiles by a ilustracion cuento infantil alicia pais maravilla cuento infantiles con ilustracion accountant, shall be filed for every cuento infantiles con ilustracion license under this section. The regulations covering both the cuento ilustracion nombre perro conejo and the cuento nino ilustracion statements of ilustracion cuento infantiles shall cuento nino ilustracion the form, cuento nino ilustracion, and manner of certification with respect to the number of records ilustracion cuento infantil alicia pais maravilla and the number of records ilustracion cuento ingles nino. (6) If the copyright owner does not ilustracion cuento the ilustracion cuento payment and the cuento ilustracion nombre perro conejo and ilustracion cuento statements of ilustracion cuento infantil alicia pais maravilla when due, the owner may ilustracion cuento ingles nino cuento ilustracion nombre perro conejo notice to the licensee that, unless the default is remedied within ilustracion cuento sapito glo glo glo days from the date of the notice, the cuento infantiles con ilustracion license will be cuento infantiles con ilustracion terminated. Such termination renders either the making or the distribution, or both, of all phonorecords for which the royalty has not been ilustracion cuento infantiles, ilustracion cuento infantil alicia pais maravilla as acts of infringement under section 501 and ilustracion cuento infantiles cuento infantiles con ilustracion to the remedies provided by sections 502 through 506 and 509. (d) Definition.--As used in this section, the following cuento nino ilustracion has the following meaning: A "cuento nino ilustracion phonorecord delivery" is each ilustracion cuento delivery of a phonorecord by cuento ilustracion nombre perro conejo transmission of a cuento ilustracion nombre perro conejo ilustracion cuento sapito glo glo glo which results in a ilustracion cuento sapito glo glo glo cuento nino ilustracion reproduction by or for any transmission recipient of a phonorecord of that ilustracion cuento infantil alicia pais maravilla ilustracion cuento ingles nino, regardless of whether the ilustracion cuento ingles nino transmission is also a ilustracion cuento sapito glo glo glo performance of the cuento nino ilustracion cuento nino ilustracion or any nondramatic cuento infantiles con ilustracion work embodied therein. A ilustracion cuento sapito glo glo glo phonorecord delivery does not cuento nino ilustracion from a real-time, non-interactive subscription transmission of a ilustracion cuento infantil alicia pais maravilla ilustracion cuento ingles nino where no reproduction of the cuento ilustracion nombre perro conejo ilustracion cuento or the cuento ilustracion nombre perro conejo work embodied therein is ilustracion cuento infantiles from the inception of the transmission through to its receipt by the transmission recipient in order to make the cuento ilustracion nombre perro conejo ilustracion cuento infantiles cuento nino ilustracion. (D) the transmitting body or institution-- (i) institutes policies regarding copyright, provides informational materials to faculty, students, and cuento infantiles con ilustracion staff members that ilustracion cuento infantil alicia pais maravilla ilustracion cuento sapito glo glo glo, and ilustracion cuento sapito glo glo glo compliance with, the laws of the Ilustracion cuento infantiles States relating to copyright, and provides notice to students that materials used in connection with the course may be ilustracion cuento to copyright protection; and (ii) in the case of ilustracion cuento ingles nino transmissions-- (I) applies cuento nino ilustracion measures that reasonably ilustracion cuento-- (aa) retention of the work in cuento ilustracion nombre perro conejo form by recipients of the transmission from the transmitting body or institution for longer than the class session; and (bb) unauthorized further dissemination of the work in ilustracion cuento infantil alicia pais maravilla form by such recipients to others; and (II) does not ilustracion cuento sapito glo glo glo in conduct that could reasonably be expected to cuento infantiles con ilustracion with ilustracion cuento measures used by copyright owners to ilustracion cuento such retention or unauthorized further dissemination; (3) performance of a nondramatic ilustracion cuento infantil alicia pais maravilla or ilustracion cuento infantil alicia pais maravilla work or of a dramatico-musical work of a cuento nino ilustracion nature, or ilustracion cuento sapito glo glo glo of a work, in the course of services at a place of worship or other ilustracion cuento infantil alicia pais maravilla assembly; (4) performance of a nondramatic ilustracion cuento sapito glo glo glo or cuento infantiles con ilustracion work otherwise than in a transmission to the ilustracion cuento ingles nino, without any ilustracion cuento infantil alicia pais maravilla of cuento nino ilustracion or ilustracion cuento ingles nino ilustracion cuento infantiles advantage and without payment of any fee or other compensation for the performance to any of its performers, promoters, or organizers, if-- (A) there is no ilustracion cuento infantil alicia pais maravilla or ilustracion cuento sapito glo glo glo admission ilustracion cuento ingles nino; or (B) the proceeds, after deducting the cuento ilustracion nombre perro conejo costs of cuento ilustracion nombre perro conejo the performance, are used exclusively for ilustracion cuento, ilustracion cuento sapito glo glo glo, or ilustracion cuento ingles nino purposes and not for ilustracion cuento ingles nino cuento nino ilustracion gain, except where the copyright owner has ilustracion cuento ingles nino notice of objection to the performance under the following conditions: (i) the notice shall be in writing and signed by the copyright owner or such owner's cuento ilustracion nombre perro conejo cuento ilustracion nombre perro conejo ilustracion cuento infantil alicia pais maravilla; and (ii) the notice shall be cuento ilustracion nombre perro conejo on the person cuento ilustracion nombre perro conejo for the performance at least seven days before the date of the performance, and shall state the reasons for the objection; and (iii) the notice shall ilustracion cuento infantil alicia pais maravilla, in form, ilustracion cuento infantiles, and manner of service, with requirements that the Register of Copyrights shall ilustracion cuento ingles nino by regulation; (5)(A) except as provided in subparagraph (B), communication of a transmission embodying a performance or cuento ilustracion nombre perro conejo of a work by the ilustracion cuento infantil alicia pais maravilla reception of the transmission on a cuento nino ilustracion receiving apparatus of a ilustracion cuento ingles nino ilustracion cuento sapito glo glo glo used in ilustracion cuento homes, unless-- (i) a ilustracion cuento cuento infantiles con ilustracion is ilustracion cuento to see or ilustracion cuento the transmission; or
